1. Agreement
Wimberley Buzz is operated by Diffyweb LLC, a Texas limited liability company (“we,” “us,” “our”). By accessing wimberleybuzz.com, subscribing to our newsletter, posting a comment, or submitting content, you agree to these Terms of Use. If you do not agree, please do not use the site.
These Terms incorporate our Privacy Policy, [Community Guidelines]([GUIDELINES URL]), and [DMCA Policy]([DMCA URL]).
2. Who May Use the Site
Anyone may read Wimberley Buzz. To create an account, post a comment, or submit content, you must be at least 13 years old. If you are under 18, you may participate only with the involvement of a parent or guardian, who agrees to these Terms on your behalf.
3. Our Content
Except for user submissions and third-party material, everything on Wimberley Buzz (articles, photographs, graphics, layout, and the Wimberley Buzz name and logos) is owned by Diffyweb LLC or licensed to us, and is protected by copyright and trademark law.
You may: read, print for personal use, and share links to our articles. You may quote a short excerpt of an article with attribution and a link back to the original.
You may not: republish our articles in full, scrape or bulk-copy the site, use our content to train machine learning models, sell our content, or use our name or logo to suggest we endorse you — in each case without our prior written permission.

4. Your Submissions
“Submissions” means anything you send or post: comments, news tips, photographs, videos, event listings, business listings, obituaries, letters, and announcements.
You keep ownership of your Submissions. You are not selling them to us.
You grant us a license. By making a Submission, you grant Diffyweb LLC a worldwide, non-exclusive, royalty-free, perpetual, irrevocable, sublicensable license to use, reproduce, edit, adapt, publish, display, distribute, and archive that Submission on Wimberley Buzz, on other Town Buzz sites, in our newsletter, and on our social media accounts, in any media now known or later developed. This includes the right to use it to promote the publication.
We are not obligated to publish anything you submit, and we may edit Submissions for length, clarity, accuracy, or style.
You promise that:
- The Submission is yours, or you have permission from the owner to give us this license
- It does not infringe anyone’s copyright, trademark, privacy, or publicity rights
- It is not defamatory, threatening, harassing, obscene, or unlawful
- Any factual claims in it are true to the best of your knowledge
- If it shows identifiable people in a private setting, you have their permission
- You are not being paid by anyone to place it, unless you have told us so in writing
Photographs: Only submit photos you took yourself or have clear rights to. Do not submit photos you found on Facebook, in a Google search, or on another news outlet’s site. Photos of minors require permission from a parent or guardian.
5. Conduct
You agree not to:
- Post content that is unlawful, defamatory, harassing, hateful, threatening, or invasive of privacy
- Impersonate any person or organization, or use a false identity to mislead readers
- Post spam, chain messages, or unauthorized commercial solicitations
- Post another person’s private information, including home address, phone number, or workplace, without their consent
- Interfere with the site’s operation, attempt to access accounts or areas you’re not authorized to reach, or introduce malware
- Use automated tools to scrape, crawl, or harvest content or user information, except a search engine operating within our robots.txt
- Encourage or assist anyone else in doing these things
6. Moderation
We may remove any content, close comment threads, or suspend or terminate accounts at any time, for any reason or no reason, with or without notice. We are not obligated to monitor Submissions, and our decision to remove some content does not create an obligation to remove other content.
Submissions are not our statements. Comments and reader submissions reflect the views of the people who wrote them, not the views of Wimberley Buzz or Diffyweb LLC. We do not verify reader comments.
7. Advertising and Sponsored Content
Wimberley Buzz carries advertising and sponsorships from local businesses and organizations, and advertises itself on third-party platforms. Advertisements and sponsored content are labeled. Advertisers do not review or approve our editorial or news coverage before publication.
Any dealings you have with an advertiser (including purchases, disputes, and warranties) are between you and that advertiser. We are not a party to them and are not responsible for them.
8. Third-Party Links
We link to other websites for your convenience. We do not control them, do not endorse them, and are not responsible for their content, products, or practices.
9. Not Professional Advice
Wimberley Buzz publishes local news and community information. Nothing on the site is legal, medical, financial, real estate, or other professional advice. Event details, business hours, closures, road conditions, and emergency information can change quickly and may be wrong or out of date.
In an emergency, rely on official sources, such as 911, the Hays County Sheriff’s Office, the City of Wimberley, or the National Weather Service; not this website.
10. Disclaimer of Warranties
THE SITE AND ALL CONTENT ARE PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, ACCURACY, AND UNINTERRUPTED AVAILABILITY. Some states do not allow the exclusion of certain warranties, so parts of this section may not apply to you.
11. Limitation of Liability
TO THE FULLEST EXTENT PERMITTED BY LAW, DIFFYWEB LLC AND ITS OWNERS, EMPLOYEES, AND CONTRIBUTORS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, LOST DATA, OR BUSINESS INTERRUPTION, ARISING FROM YOUR USE OF OR INABILITY TO USE THE SITE, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY.
OUR TOTAL LIABILITY FOR ANY CLAIM RELATING TO THE SITE WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US IN THE TWELVE MONTHS BEFORE THE CLAIM AROSE, OR (B) ONE HUNDRED DOLLARS ($100).
Some states do not allow these limitations, so parts of this section may not apply to you.
12. Indemnification
You agree to indemnify and hold harmless Diffyweb LLC and its owners, employees, and contributors from any claim, demand, loss, or expense (including reasonable attorneys’ fees) arising out of your Submissions, your use of the site, or your violation of these Terms or of any law or third-party right.
13. Resolving Disputes
Talk to us first. Before filing any legal action, please email hello@wimberleybuzz.com with a description of the problem and what you want. We will try in good faith to resolve it within 30 days. Most problems, like factual error(s), unwanted photo(s), moderation decision(s), etc., get fixed faster this way.
Governing law and venue. These Terms are governed by the laws of the State of Texas, without regard to its conflict-of-laws rules. Any lawsuit must be brought exclusively in the state or federal courts located in Hays County, Texas, and you consent to the jurisdiction of those courts.
14. Changes to These Terms
We may change these Terms. We will update the Effective Date and, for material changes, post a notice on the site. Continuing to use the site after a change means you accept the revised Terms.
15. General
If any provision of these Terms is found unenforceable, the rest remain in effect. Our failure to enforce a provision is not a waiver of it. These Terms, together with the documents they incorporate, are the entire agreement between you and us about the site. You may not assign these Terms; we may assign them to a successor.
